Property Owner Fined

Coimbatore District Consumer Disputes Redressal Forum has slapped a fine of Rs. 31,000 on a property promoter for having caused mental agony to a property owner by refusing permission for Bharat Sanchar Nigam Limited to lay cables to provide landline phone connections. N. Sivan of Mayflower Sakthi Garden, Nanjundapuram Road, Ramanathapuram, moved the consumer forum stating that his application for shift of telephone to Mayflower apartment has not been considered even after seven months. The Principal General Manager of BSNL submitted that the property promoter was not granting permission to lay cables. The company was willing to honour the application within seven days but for the refusal on the part of the promoter in giving permission.

V. Mohan, managing director of Mayflower Enterprises, submitted that the residents were at their liberty to get a telephone connection of their choice. But, he said, permission cannot be granted for digging of the ground at this stage. The forum consisting president S.A. Sreeramulu and members P. Madhavi and K. Rathinam, ordered the property promoter to forward a copy of the letter addressed to BSNL granting permission to draw cables, within 30 days from the date of the order.



The telephone connection could be given to the petitioner and other residents without waiting for the letter. The forum ordered that the second opposite party should pay the complainant Rs. 10,000 as compensation towards cost of telephone charges, cell phone charges and Rs. 20,000 for causing mental agony and Rs. 1,000 as cost of the litigation within two months from the date of the order.
