HC Directed To Refund

The Madurai Bench of the Madras High Court on Tuesday directed a Coimbatore-based nursing college to refund the fee with interest collected from a student within two weeks. In a petition before the Bench, student Starline Jeba of Madurai said, she applied for a graduation course in nursing and was asked to join the J K College of Nursing and Paramedical in Coimbatore. She joined the college on October 8, 2004, after paying Rs 43,500.

Later, the additional director medical education, directed her to switch to another college since the Coimbatore institute had not been granted recognition by the Dr MGR Medical University. She, therefore, joined the CSI Annapackiam College of Nursing in Madurai and sought fee refund from the J K College. But the Coimbatore college refused to oblige.



In her suit, Jeba demanded a compensation of Rs 1 lakh from the college. Justice K Chandru, before whom the petition came up, held that it was wrong on the part of J K College to have admitted a student without getting medical university recognition. The student had every right to claim a refund, Chandru said. HC directed the college to pay Jeba Rs 75,000 as fee and interest within two weeks.
