False case court ordered

The Judicial Magistrate Court No VII, accepting the final report of the Special Investigation Team of the CB-CID, has issued orders stating that the case relating to the arrest of five persons of Manitha Neethi Pasarai (MNP) and recovery of explosives on July 22, 2007, is false.It may be noted that on July 22, the Coimbatore City Police arrested Haroon Basha, Malik Basha, Thippu Sulthan, Bolo Shankar and Athikur Rehman after raiding premises at Podanur, Ganapathy and at Sungam near Ramanathapuram. It was stated that the five owing affiliation to MNP had planned to set off explosions in the city. The police stated that explosive substances had been recovered from them.

Cases were registered against them under sections 120 B of Indian Penal Code and Section 5 of the Explosive Substances Act of 1908.Following uproar that it was a false and fabricated case, the investigation was handed over to SIT of the CB-CID.A team led by R. Balan, Additional Superintendent of Police, CB-CID, SIT, conducted investigations.Citing inconsistencies, contradictions in depositions of the accused and the police officers involved in the arrest, the SIT, in its final report submitted to the court in December 2007, stated that the case was false and fabricated.Advocate Mohammed Abubacker, the defence counsel for the accused, told that a petition would be filed on behalf of the accused before the magistrate court seeking to initiate appropriate action against the officers concerned for forgery and fabrication of records.
